Do you qualify after five years?
Long-term residence authorises you to live and work in Spain indefinitely, on the same terms as Spaniards. The right comes to people who have held temporary residence in Spain for five continuous years and meet the regulation’s conditions.

The legal test for national long-term residence reads as follows.
Tendrán derecho a obtener una autorización de residencia de larga duración nacional las personas extranjeras que hayan residido legalmente y de forma continuada en el territorio español durante los cinco años previos a la presentación de la solicitud.
Foreigners who have resided lawfully and continuously in Spanish territory during the five years before filing the application have the right to obtain a national long-term residence authorisation.
BOE · Real Decreto 1155/2024, art. 183.1
A holder of a contributory Spanish retirement pension also qualifies for national long-term residence.
The timeline from your visa
The visa year is the first stretch of residence, and renewals fill the rest. On the non-lucrative route, the first authorisation lasts one year. A renewed temporary authorisation lasts two years, unless you qualify for long-term residence.
The teleworker permit lasts up to three years and renews in two-year periods. See the digital nomad requirements and the non-lucrative requirements for each route.

How many days can you be away?
Short trips do not reset the clock. Continuity is not broken by absences of up to six continuous months, as long as the total absences within the five years stay within ten months. That holds unless the departures were irregular.
| Absence type | Longest single absence | Total over five years |
|---|---|---|
| Any reason | Six months | Ten months |
| Work reasons | Six months | Eighteen months |
Absences caused by duly justified force majeure do not break continuity either, and the competent body assesses each case. Non-lucrative renewals have their own rule on top: more than 183 days of real residence in the calendar year.

Applying in Valencia
From inside Spain, send the application on the official form to the Oficina de Extranjería of the province where you live. For Valencia, that is the Oficina de Extranjería, Sede 1, Calle Diputada Clara Campoamor, 23. Filing electronically through the Ministry’s Mercurio portal needs a digital certificate or an electronic DNI.

The filing window
File during the two months immediately before your residence authorisation expires, and the old permit stays valid until the decision. Filing within three months after expiry also extends it, without prejudice to a penalty procedure. The window does not apply to holders of a valid authorisation who already meet the five-year test.
Documents
- A full copy of your valid passport.
- The form showing the fee was paid.
- A report from the competent authorities showing that school-age children in your care are enrolled, when the application rests on earlier residence periods.
- A criminal record certificate from your home country or the countries you lived in during the last five years, when applicable.
The office checks your earlier residence periods in Spain and obtains the Spanish criminal record certificate and the police report itself. It may refuse the status if it considers you a threat to public order or public security.
Fee and wait
The authorisation fee is €21.87. The competent body resolves and notifies within three months of receiving the application, and after that the application is deemed granted.

The US and UK visa documents guide covers the paperwork for US and UK applicants.
The TIE after the grant
After the grant, request the TIE in person within one month of notification. A long-term residence TIE application goes to any Oficina de Extranjería or Comisaría de Policía. In Valencia city, non-EU cards are issued at the Comisaría de Patraix, calle dels Gremis 6. The TIE fee is €21.87.

Renew the TIE first after five years, then every five years until the holder turns thirty and every ten years afterwards. File the renewal in the two months before the card expires. Missing the deadline does not extinguish the residence, but the office checks that the conditions for access still hold.

The TIE guide for Valencia covers the police appointment. A padrón registration for a foreigner without long-term residence renews every two years, so keep your registration current until you hold it.
EU long-term residence
Long-term-EU residence is a separate authorisation. It needs lawful and continuous residence in Spain during the five years before applying. It also needs fixed and regular resources for you and your family, measured with the family-reunification rules. Add health insurance.

Decided in three months, the application is deemed granted if no answer comes.
How long-term residence ends
National long-term residence is lost after absence from EU territory for 12 consecutive months. The Reglamento sets exceptions and a procedure to recover it. Long-term-EU residence also ends after six years’ absence from Spanish territory, though the Dirección General may decide otherwise for exceptional reasons.

Does this lead to nationality?
Nationality by residence needs ten years of residence. Five years suffice for refugees, and two for nationals of origin of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea or Portugal, or Sephardic Jews. In every case the residence must be legal, continuous and immediately before the application.

Common questions
How long until I can apply for permanent residency?
Five years: you need to have resided lawfully and continuously in Spain for the five years before you apply. The office checks the earlier residence periods itself when it receives the application.
How long can I be outside Spain?
Absences of up to six continuous months do not break continuity, if together they stay within ten months over the five years. For work absences the total limit is eighteen months.
When do I file?
As soon as you qualify, if you hold a valid permit and already meet the five-year test. Otherwise file during the two months before your permit expires; filing in that window keeps the permit valid until the decision.
Do I need to file before the permit expires?
Ideally yes, but filing within three months after expiry also extends the authorisation, without prejudice to a penalty procedure. The two-month window does not apply to holders of a valid authorisation who already meet the five-year test.
How long does the decision take?
Three months. The competent body resolves within three months of receiving the application. After that period the application is deemed granted.
Does my TIE expire?
Yes, on a schedule: the TIE renews first after five years, then every five years until the holder turns thirty and every ten years afterwards. Missing the renewal does not extinguish the residence.
Can I lose long-term residence?
Yes, after absence from EU territory for 12 consecutive months. The Reglamento sets exceptions and a procedure to recover it.
Does this lead to Spanish citizenship?
Not directly: nationality by residence needs ten years of residence, which must be legal, continuous and immediately before the application.
